BRIEF DESCRIPTION: The beneficiary seeks to procure (or has sought to procure or has procured) immigration benefits by fraud or misrepresentation.

DETAILS: Alien is inadmissible (under this ground) only if the misrepresentation is willful.

FILING DATE RESTRICTIONS: None.
EXCEPTIONS: None.
SPECIFIC WAIVERS: Under INA 212(i)(1) – If:

the alien is the spouse, son, or daughter of a U.S. citizen or of a permanent resident, and

the refusal of admission to the U.S. of such immigrant alien would result in extreme hardship to the citizen or lawfully resident spouse or parent of such an alien.

COURT JURISDICTION: Under INA 212(i)(2) – No court shall have jurisdiction to review INS decision
to grant or deny waiver.
