Certain Employment-Based Immigrants

CLASSIFICATION:

BRIEF DESCRIPTION: The beneficiary is a prospective employment-based immigrant.

DETAILS:

1. The beneficiary may be determined inadmissible under INA 212(a)(4)(D), unless affidavits of support (Form I-864) is presented.

2. Affidavits of support is required only from employment-based immigrants who are coming to work for relatives or for companies where relatives of the immigrant own 5 percent or more of the company.

3. The beneficiary may be determined inadmissible under INA 212(a)(5)(A)(i), unless a labor certification
is obtained.
